In your practice you have helped many clients to restore justice after problems with business partners. However, how can you help them at an earlier stage of the process – the signing of the contract?

Consulting with a lawyer before signing a trade deal and, for that matter, any contract is crucial in regard to prevention and aversion of future problems, minimising the risk of breach of contract, establishing warranties and sanctions that will guarantee the implementation and will possibly compensate any damages caused by failure to comply. It can also clarify the applicable law in international deals.

Why is it important to use an attorney's services in real estate deals, too?

In a real estate deal the lawyer will check and survey the ownership of both the seller and the previous owners. How they acquired it, are there possibilities for third parties to declare their rights on the property, is there a mortgage that the new owner should pay. The detailed check up is important to establish whether the property is free of burdens and if the buyer can use it trouble-free.

In Bulgaria, many people buy properties under construction. In these cases it is important to check the developer, the construction documentation and the ownership documents. I had a case when the clients were offered a property and a preliminary contract was signed, but when the building was finished they found out that their real estate is on a different floor, with different exposition and characteristics. In another case, for the same property several preliminary contracts with different clients were signed. The practice of transaction recognition at lower than the actual price continues. However, in this case, your money will not be protected if the deal is declared null and void or the buyer is evicted.

The cases and possible problems are countless. This is why I advise people to consult with a good lawyer in the field of law of obligations, real right and commercial law, and to sign a real legal deal in accordance with their true will and wishes that will give them security and comfort.

What is the most important thing that makes you a successful lawyer working for the good of the clients?

First – I love law and my profession very much. A favourite Latin epigrame is also my main principle in work: law is the art of goodness and fairness. I am extremely resilient and ready to fight, I read a lot, I strive for precision in my work, exploration of every detail and empathy towards the client. The knowledge that I am on the side of justice has always given me power and energy to continue the fight.

Консултацията с адвокат преди сключване на търговска сделка и въобще договор е изключително важна с оглед превенция и предотвратяване на бъдещи проблеми, минимизиране на риска от неизпълнение на договора, поставяне на гаранции и санкции, които ще гарантират изпълнението и евентуално ще обезщетят вредите от неизпълнението, уговаряне на приложимото право при международни сделки.

Защо е важно да ползваме услугите на адвокат и при сключване на сделки с недвижими имоти?

При сключване на сделка с недвижим имот адвокатът проверява и изследва собствеността и на продавача, и на неговите прехвърлители назад във времето. Как те са го придобили, възможно ли е трети лица да заявят претенции към имота, има ли ипотека за изплащане, която се прехвърля върху новия собственик. Детайлната справка е важна, за да установим дали имотът няма вещни тежести и може ли купувачът да го ползва спокойно.

В България много хора купуват имоти в строеж. В тези случаи е много важно да се провери строителната фирма, строителната документация, документите за собственост. Имала съм случай, когато на хора е предложен имот и подписан предварителен договор, а след завършване на сградата се оказва, че имотът е на друг етаж, с друго изложение и характеристики. При друг случай за един и същ имот бяха сключени няколко предварителни договора. Продължава и изповядването на сделки на по-ниска от продажната цена. Така при евентуално разваляне на сделката или евикция на купувача парите ви не са защитени.

Безброй са случаите и възможните проблеми. Затова съветвам хората да се консултират с добър адвокат в сферата на облигационното, вещното и търговското право и да сключат действителна правна сделка, съобразно действителната им воля и желание, която ще им осигури спокойствие и комфорт.

Кое е най-важното качество, което Ви прави успешен адвокат, работещ в полза на клиентите?

На първо място – много обичам правото и професията си. Една любима латинска сентенция е и мой принцип в работата ми: правото е изкуство на доброто и справедливостта. Аз съм изключително борбена, чета много, старая се да съм прецизна в работата си, да изследвам всеки момент и да имам емпатия към клиента. Това, че стоя от страната на справедливостта, ми е давало много сила и енергия да се боря.
